These Terms of Service govern your access to and use of the Calsence mobile application, calsense.app, and related features, content, support, and backend services. By creating an account, accessing Calsence, or continuing to use it after these Terms take effect, you agree to these Terms and the Privacy Policy.

If you do not agree, do not use Calsence. Certain app-store, device-platform, identity-provider, health-integration, and payment-provider terms also apply to features supplied by those third parties.

What Calsence Provides

Calsence is a general wellness and fitness tool. Depending on your device, account, region, subscription status, and feature availability, it may provide:

• Meal search, manual logging, nutrition tracking, custom foods, water tracking, weight tracking, and progress summaries.
• AI-assisted food-photo analysis with estimated foods, portions, calories, and macronutrients.
• AI Coach responses and AI-generated diet plans.
• Optional Apple Health or Health Connect activity summaries.
• Goals, reminders, reports, support requests, and related wellness tools.

Features can change, be limited, remain in preview, or be unavailable in some regions. Calsence may apply free or paid usage limits to AI and other resource-intensive features.

Eligibility

You must be legally able to agree to these Terms. Calsence is not directed to children under 13 or the higher minimum age required by local law. If you are under the age of legal majority, a parent or legal guardian must review and agree to these Terms where required.

You may not use Calsence if applicable law prohibits you from receiving the service or if your account was previously terminated for serious or repeated violations.

Your Account

You may register with email and password or use an available provider such as Sign in with Google or Sign in with Apple. You agree to:

• Provide accurate account and profile information and keep it reasonably current.
• Protect your device, password, email account, and linked sign-in methods.
• Never share one-time codes, authentication links, or account access with an unauthorized person.
• Notify Calsence support promptly if you suspect unauthorized access.
• Accept responsibility for activity performed through your account unless caused by a failure for which Calsence is legally responsible.

One person should not create accounts to evade usage limits, access controls, enforcement, or subscription requirements. Calsence may require reauthentication or identity verification before sensitive account actions.

License To Use Calsence

Subject to these Terms, Calsence grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the app for lawful personal wellness purposes.

You may not copy, sell, rent, sublicense, distribute, reverse engineer, attempt to extract source code, bypass security controls, scrape the service, or use Calsence branding or content except where applicable law expressly permits it or written permission is provided.

Your Content And Instructions

You retain ownership of information and content you submit, such as meal photos, food entries, notes, goals, prompts, preferences, support messages, and attachments. You give Calsence a limited, worldwide license to host, copy, transmit, format, analyze, and otherwise process that content only as needed to operate, secure, support, and improve the service in accordance with the Privacy Policy.

You confirm that you have the rights needed to submit the content and that it does not violate law, privacy, intellectual-property rights, or another person's rights. Do not upload passwords, payment-card details, government identifiers, illegal content, or personal information that is unnecessary for a feature.

Calsence may remove or restrict content that creates security, legal, safety, or operational risk.

Wellness And Medical Disclaimer

Calsence provides general wellness estimates, planning tools, and educational information. It is not a medical device, healthcare provider, dietitian, emergency service, or substitute for professional medical advice, diagnosis, or treatment.

• Do not use Calsence to diagnose a condition, set medication, manage an emergency, or replace advice from a qualified professional.
• Contact local emergency services immediately if you may be experiencing a medical emergency.
• Consult an appropriate professional before making material diet, exercise, fasting, weight, or health changes, particularly if you are pregnant, under 18, have allergies, take medication, have an eating disorder, or have a medical condition.
• Stop an activity and seek appropriate help if you feel unwell, faint, experience pain, or have another concerning symptom.

Calorie targets, macro targets, energy expenditure, hydration suggestions, progress forecasts, and similar values are approximations. Individual needs and results vary.

Food, Allergy, And Nutrition Information

Food information can differ by recipe, brand, cooking method, portion, restaurant, country, and database source. You are responsible for reviewing and correcting a meal before relying on it.

AI food scans cannot reliably identify every ingredient, allergen, contamination risk, preparation method, or exact portion. Never use a scan result to decide whether a food is safe for an allergy, intolerance, religious restriction, medical diet, or other high-risk decision. Check labels, ingredients, and the food provider directly.

AI Features And Estimates

AI features may generate incorrect, incomplete, outdated, inconsistent, or unsuitable information. A confidence indicator describes model certainty or matching quality; it is not a guarantee of accuracy.

When you use AI features, you agree that:

• You will review food names, portions, nutrition values, exercises, meal plans, and guidance before acting on them.
• You will not treat an AI response as medical, legal, financial, or other professional advice.
• You will not use Calsence AI to create harmful, unlawful, deceptive, abusive, or rights-infringing content.
• Outputs may vary between requests and may be limited, filtered, refused, or corrected for safety and quality reasons.
• Calsence may route inputs to third-party AI providers through secure backend services as explained in the Privacy Policy.

You should report a materially inaccurate or unsafe food result through the app's reporting tools where available.

Health Integrations

Apple Health and Health Connect integrations are optional. You decide whether to grant access and can revoke it in device settings. Calsence currently uses approved read-only activity types such as steps, active energy, distance, and exercise or activity minutes to produce daily summaries.

Health data can be delayed, duplicated, missing, estimated, or attributed to another device or application. Calsence does not guarantee that a health integration is continuously available or that every source reports data in the same way.

Disconnecting Calsence or deleting a Calsence account does not remove source records independently maintained by Apple Health, Health Connect, a wearable, or another application.

Reminders And Notifications

Reminders and push notifications are convenience features. Delivery is not guaranteed and can be affected by device settings, battery restrictions, network availability, platform services, time-zone changes, or app updates. Do not rely on Calsence notifications for medication, emergencies, safety-critical events, or time-sensitive medical needs.

Paid Features And Subscriptions

If Calsence offers paid features, the price, billing interval, trial terms, taxes, currency, and available benefits will be shown in the Apple App Store or Google Play purchase flow before you confirm a purchase. Store terms and regional availability apply.

• Subscriptions may renew automatically unless cancelled through the relevant app-store account before the renewal deadline shown by the store.
• You manage cancellation, billing methods, receipts, and eligible refund requests through Apple or Google, unless the store directs you otherwise.
• Deleting Calsence or deleting your Calsence account does not automatically cancel an app-store subscription.
• Removing a payment method or stopping use of a paid feature does not by itself cancel a subscription.
• Feature access can end when a subscription expires, is refunded, is reversed, or cannot be verified.
• Calsence may change future prices or plan benefits with notice required by law and app-store rules.

Do not purchase until the store screen shows terms you understand and accept. Website descriptions are summaries and do not override the purchase terms presented by the store.

Acceptable Use

You must not:

• Break the law, infringe another person's rights, or encourage harmful conduct through Calsence.
• Upload malware, abusive content, unlawful images, or content you are not authorized to process.
• Probe, attack, overload, disrupt, or bypass authentication, App Check, rate limits, subscriptions, usage limits, or security controls.
• Access another user's account or data, impersonate a person, misrepresent an affiliation, or submit fraudulent support reports.
• Automate requests, scrape data, resell outputs, or use the service to build or benchmark a competing model or service without written permission.
• Extract, expose, or attempt to discover backend credentials, prompts, models, private endpoints, or non-public datasets.
• Use Calsence for clinical care, emergency monitoring, or another regulated or high-risk purpose for which it was not designed.

Calsence may investigate suspected misuse and apply proportionate limits or suspension.

Intellectual Property

Calsence and its licensors own the application, website, designs, software, branding, documentation, and service content, excluding your content and third-party materials. These Terms do not transfer ownership to you.

If you provide feedback or suggestions, you permit Calsence to use them without restriction or payment, provided that doing so does not publicly identify you without permission.

Third-Party Services

Calsence depends on services provided by Firebase and Google Cloud, OpenAI, Apple, Google, app stores, health platforms, notification infrastructure, and other vendors. Your use of third-party features can be subject to separate terms and privacy policies.

Calsence is not responsible for a third party's independent service, account, content, availability, billing decision, or data practice. References or links do not imply endorsement. Mandatory consumer protections and responsibilities that cannot lawfully be excluded remain unaffected.

Privacy

The Privacy Policy explains how Calsence processes personal information. By using the service, you acknowledge those practices. Optional permissions such as camera, photos, notifications, Apple Health, and Health Connect remain subject to the choices available on your device.

Availability, Changes, And Mandatory Updates

Calsence may add, modify, limit, pause, or discontinue a feature to improve safety, comply with law or platform policy, address security issues, manage cost, or maintain the service. We do not promise uninterrupted or error-free operation.

Some releases may be designated as mandatory. In that case, an older version may be blocked until you install the minimum supported version from the official app store. Mandatory updates may be used for security, privacy, compatibility, legal compliance, or critical reliability fixes. You are responsible for maintaining compatible device software, network access, and an official app-store account where required.

Suspension And Termination

You may stop using Calsence at any time. To request permanent account and associated data deletion, follow calsense.app/delete-account. Uninstalling the app alone does not close your account or cancel a subscription.

Calsence may limit, suspend, or terminate access if reasonably necessary because of serious or repeated violation of these Terms, fraud, abuse, security risk, legal requirement, non-payment, or danger to users or the service. Where appropriate and legally required, we will provide notice and an opportunity to address the issue.

Sections that by their nature should continue after termination remain in effect, including ownership, payment obligations already incurred, disclaimers, liability limits, and dispute provisions.

Disclaimers

To the maximum extent permitted by applicable law, Calsence is provided on an as-is and as-available basis. Calsence disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability where those warranties may lawfully be disclaimed.

Calsence does not warrant that AI outputs, nutrition records, health-platform data, goals, plans, reminders, or progress estimates are complete or suitable for your personal circumstances. Nothing in these Terms excludes a warranty or consumer right that applicable law does not allow us to exclude.

Limitation Of Liability

To the maximum extent permitted by law, Calsence and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, or opportunity arising from your use of the service.

Calsence is not responsible for harm caused by relying on an unreviewed AI estimate, using the app for a medical or emergency purpose, failing to cancel an app-store subscription, or using inaccurate third-party health or food information, except where liability cannot lawfully be limited.

If applicable law does not allow a limitation in this section, it applies only to the greatest extent the law permits. Nothing excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or another liability that cannot legally be excluded.

Applicable Law And Disputes

These Terms are governed by the laws that apply to the Calsence operator and your use of the service, without removing mandatory consumer protections available in your country. Before starting formal proceedings, you and Calsence should make a reasonable effort to resolve a dispute through support, unless urgent relief or applicable law makes that inappropriate.

Any court or authority with mandatory jurisdiction keeps that jurisdiction. No part of these Terms requires you to waive a non-waivable statutory right.

Changes To These Terms

Calsence may update these Terms when the service, providers, laws, or business model changes. The version and effective date will be updated on this page. Material changes will receive additional notice where required. If you do not accept an updated version, stop using Calsence and request account deletion before the new Terms take effect where that option is required by law.

General Terms

If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A delay in enforcing a provision is not a waiver. You may not transfer your rights or obligations under these Terms without permission; Calsence may transfer them as part of a legitimate reorganization, financing, or sale with required protections and notice.

These Terms, the Privacy Policy, and purchase terms shown by the applicable app store form the agreement concerning your use of Calsence, subject to additional terms presented for a specific feature.
